Calabria Ranch HOA, LLC<\/em> defines what can reasonably be expected, unreasonable restrictions, and how to change CC&amp;Rs.<\/h3>\n<p><a href=\"https:\/\/scholar.google.com\/scholar_case?case=17097667242890540042\" target=\"_blank\" rel=\"noopener\">https:\/\/scholar.google.com\/scholar_case?case=17097667242890540042<\/a><\/p>\n<p>An analysis of the ruling:<br \/>\n<a href=\"https:\/\/www.chdblaw.com\/ccr-amendment-update-arizona-supreme-court\/\" target=\"_blank\" rel=\"noopener\">https:\/\/www.chdblaw.com\/ccr-amendment-update-arizona-supreme-court\/<\/a><\/p>\n<ul>\n<li>This ruling impacts the MCA&#8217;s attempts to enforce CC&amp;Rs.<\/li>\n<li>I&#8217;ve seen numerous posts on Facebook regarding the MCA threatening to enforce the removal of allegedly prohibited shipping containers.<\/li>\n<\/ul>\n<p><strong>Shipping containers appear to be allowed as per the County regulations.<\/strong><\/p>\n<p>The County regulations continually change, be sure to rely on the current regs. Please send me the link, thanks!<\/p>\n<p><strong>11\/19\/25 update:<\/strong>\u00a0 I had emails with the County confirming that shipping containers are legal for our RE Zoning.\u00a0 Will post the link when I have more time.<\/p>\n<p>I also confirmed that living in campers permanently is allowed as long as you have a septic hookup and pay the annual fee &#8212; contrary to MCA director Baur&#8217;s vile FALSE claims.<\/p>\n<p><strong>It appears that the MCA is trying to amend the CC&amp;Rs without actually amending them.<\/strong><\/p>\n<p>I just saw one Unit&#8217;s restriction on METAL buildings and will have to analyze the various Units&#8217; CC&amp;Rs. If I had more time, I would create a table for easy comparison of the various restrictions in the Units.\u00a0 Would someone like to contribute?<\/p>\n<p><strong> Many CITIES allow chickens, and it is unreasonable to prohibit chickens in the water haul Units.<\/strong><\/p>\n<p>It makes NO sense that out in Unit 7 off Charles (water haul) the CC&amp;Rs prohibit chickens, but in Meadview they&#8217;re allowed.\u00a0\u00a0 Many of these restrictions imposed around 1970 were created to support the false promises of a golf course and marina at South Cove and LUXURY development.\u00a0 Obviously, this did not happen, as evidenced by the countless ancient single-wide trailers, campers, abandoned and destroyed properties, etc.<\/p>\n<p><strong>My CC&amp;Rs (Unit 7) prohibit wells.<\/strong><\/p>\n<p>Is that a reasonable restriction?\u00a0 Enforceable?<\/p>\n<p><strong>11\/19\/25 update:\u00a0<\/strong> I did not receive the AMENDED Unit 7 CC&amp;Rs allowing wells to be drilled when I purchased in 2006 and Jonathan Kiser was my agent.<\/p>\n<p><strong>IMPORTANT:<\/strong>\u00a0 Even if your property is NOT in the MCA, the CC&amp;Rs recorded against your property still apply to you.\u00a0 Check your title policy for any mention of CC&amp;Rs.\u00a0 In my research I found that ALL Unit 7 lots have CC&amp;Rs, even when NOT in the MCA.\u00a0 The MCA is the designated enforcer.<\/p>\n<ul>\n<li>Even if the MCA is dissolved, the CC&amp;Rs stay until the residents vote to eliminate or remove the CC&amp;Rs.\u00a0 Without the MCA to enforce the CC&amp;Rs, property owners can enforce the CC&amp;Rs in court.<\/li>\n<\/ul>\n<p>The requirements to eliminate or amend the CC&amp;Rs are in <strong>that<\/strong> Unit&#8217;s CC&amp;Rs.\u00a0 Often a percentage of the owners in &#8220;that&#8221; Unit has to vote for the changes.
